Terms of Service

Welcome to Gummely. These Terms of Service (“Terms”) govern your access to and use of the Gummely website (gummely.com) and the Gummely mobile applications (collectively, the “Service”).

The Service is owned and operated by Patrik Suter, located in the Canton of Luzern, Switzerland (“we,” “us,” or “our”).

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 (or the age of legal majority in your jurisdiction), you may use the Service only with the supervision and consent of a parent or legal guardian who agrees to be bound by these Terms.

2. User Accounts

To access certain features, you may be required to register an account. You agree to provide accurate information and maintain the security of your password. You are responsible for all activities that occur under your account.

3. Subscriptions, Payments, and Refunds

A. In-App Purchases (Apple & Google)

If you purchase a subscription via the Apple App Store or Google Play Store, your payment is processed by the respective platform. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription at any time through your App Store account settings. Refunds are governed exclusively by the policies of Apple or Google.

B. Web Purchases (Stripe)

We use Stripe for secure web payments. Refunds are provided only at our sole discretion or where explicitly required by Swiss mandatory law.

4. AI Services and Content

Gummely utilizes artificial intelligence technologies (including OpenAI and Google Gemini). You acknowledge that AI is not error-free and may generate inaccurate, outdated, or inappropriate information. You agree not to rely on the Service for professional (medical, legal, or financial) advice.

5. Prohibited Conduct

You agree not to use the Service for illegal purposes, reverse engineer the software, transmit malware, or harass others.

6. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, or consequential damages. In no event shall our aggregate liability exceed CHF 100 or the amount you paid to us in the last 12 months, whichever is greater. Nothing in these Terms limits liability for intent or gross negligence as required by Swiss law.

7. Governing Law

These Terms are governed by the laws of Switzerland, excluding its conflict of law principles. The exclusive place of jurisdiction is Luzern, Switzerland.
