Terms of Service

Welcome to Gummely. These Terms of Service (“Terms”) govern your access to and use of the Gummely website (gummely.com) and the Gummely mobile applications (collectively, the “Service”).

The Service is owned and operated by Patrik Suter, a private individual located in Ebikon, Luzern, Switzerland (“we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 (or the age of legal majority in your jurisdiction), you may use the Service only with the supervision and consent of a parent or legal guardian who agrees to be bound by these Terms.

2. User Accounts

To access certain features, you may be required to register an account. You agree to provide accurate information and maintain the security of your password. You are responsible for all activities that occur under your account.

3. Subscriptions, Payments, and Refunds

A. In-App Purchases (Apple & Google)

If you purchase a subscription via the Apple App Store or Google Play Store, your payment is processed by them. Subscriptions automatically renew unless cancelled 24 hours before the period ends. Refunds are handled exclusively by Apple or Google.

B. Web Purchases (Stripe)

We use Stripe for web payments. Refunds are provided only at our sole discretion or where required by Swiss law. We do not offer a standard money-back guarantee.

4. AI Services and Content

Gummely utilizes AI (OpenAI, Google Gemini). You acknowledge that AI is not perfect and may generate inaccurate or inappropriate information. Do not rely on the Service for professional advice.

5. Prohibited Conduct

You agree not to use the Service for illegal purposes, reverse engineer the software, transmit malware, or harass others.

6. Limitation of Liability

To the maximum extent permitted by law, Patrik Suter shall not be liable for any indirect or consequential damages. Our aggregate liability shall not exceed CHF 100 or the amount paid in the last 12 months.

7. Governing Law

These Terms are governed by the laws of Switzerland. Exclusive jurisdiction lies with the courts of the Canton of Luzern, Switzerland.
